1. Agreement to Terms

By downloading, installing, or using Forge (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

Forge is provided by Opalno, a software company based in the Netherlands (“we”, “us”, “our”).

These Terms apply to all users of Forge on iOS. Please also review our Privacy Policy, which describes how we handle your data.

2. Description of Service

Forge is a paid subscription app that provides the following features:

• Customizable morning and evening routine protocols
• Precision step-by-step timer with haptic feedback
• Morning Score (daily performance rating 0–100)
• Heat streak tracking for daily consistency
• Identity progression system (Spark to Tempered)
• Smart schedule with auto-calculated bedtime and wake notifications
• Weekly reflection journaling
• Quick sessions for anytime practice

Forge requires a paid subscription to access. The App uses anonymous authentication and does not require an email address or traditional account creation.

3. Eligibility

You must be at least 16 years old to use Forge, in accordance with GDPR consent age requirements.

By using the App, you represent and warrant that you are at least 16 years of age. If you are under 16, you may not use Forge.

4. Account & Data

Forge uses anonymous authentication. Your account is created automatically when you first use the App, without requiring an email address or password. Your data is associated with an anonymous user ID.

Account deletion is available at any time within the App under Settings → Delete Account. When you delete your account:

• All your personal data will be permanently removed from our servers within 30 days
• This includes routine data, scores, streaks, journal entries, and preferences
• This action is irreversible
• Your active subscription will not be automatically cancelled — you must cancel it separately through the Apple App Store

5. Subscriptions & Billing

By subscribing to Forge, you agree to the following:

• Billing: All payments are processed through the Apple App Store via Apple StoreKit 2. Opalno does not process or store payment information. Prices are in USD and may vary by region based on Apple's pricing matrix.
• Auto-Renewal: Your subscription automatically renews at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the renewal date. The renewal charge will be applied to your Apple ID account.
• Free Trial (Annual Plan): The annual plan includes a 7-day free trial. If you do not cancel before the trial ends, you will be charged $39.99 for the first year. The free trial is available once per Apple ID.
• Price Changes: We may change subscription prices from time to time. Any price changes will take effect at the start of your next billing period. Apple will notify you in advance of any price increase and request your consent where required.

6. Cancellation & Refunds

Refunds: All subscription purchases are processed by Apple. Refund requests must be submitted to Apple through their standard refund process. Opalno does not have the ability to issue refunds directly. Refunds are subject to Apple's refund policies and applicable consumer protection laws.

If you are in the EU, you have the right to withdraw from a digital content purchase within 14 days, provided that you have not started using the service. By subscribing and using Forge, you acknowledge that you request immediate access to the service and consent to the loss of your right of withdrawal upon commencement of the service.

7. Health & Safety Disclaimer

By using Forge, you acknowledge and agree to the following:

• Consult a Healthcare Provider: Before starting any exercise, wellness, or physical routine suggested by or configured through Forge, you should consult with a qualified healthcare provider, especially if you have any pre-existing medical conditions.
• Cold Shower Risks: Cold water exposure (cold showers, ice baths) carries inherent health risks including but not limited to cold shock response, hyperventilation, cardiac stress, hypothermia, and loss of consciousness. These risks are elevated for individuals with cardiovascular conditions, respiratory conditions, Raynaud's disease, or other medical conditions. You assume all risk associated with cold water exposure.
• Exercise Risks: Physical exercise carries inherent risks of injury. You are responsible for ensuring any exercise included in your routine is appropriate for your fitness level and physical condition.
• Mental Health: Forge's discipline and streak systems are designed to encourage consistency. If you experience anxiety, compulsive behavior, or negative mental health effects from using the App, please discontinue use and consult a mental health professional.
• No Liability: Opalno is not liable for any injuries, health issues, or adverse effects resulting from any practice, exercise, or routine performed in connection with using Forge.

8. Intellectual Property

All content in the App, including but not limited to text, graphics, icons, images, user interface design, software code, and the Forge brand identity, is the property of Opalno and is protected by Dutch and international copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to an active subscription. This license does not include the right to:

• Copy, reproduce, or redistribute App content
• Modify, adapt, or create derivative works from the App
• Use App content for any commercial purpose
• Remove any copyright or proprietary notices
• Sublicense, sell, or transfer your access to the App

9. Acceptable Use

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Use automated systems (bots, scrapers, crawlers) to extract data or content from the App
• Redistribute, republish, or commercially exploit App content without written permission from Opalno
• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to interfere with the App's functionality, servers, or networks
• Share, transfer, or sell your subscription access to others
• Circumvent or attempt to circumvent subscription or payment mechanisms

10. Disclaimer of Warranties

11. Limitation of Liability

To the maximum extent permitted by applicable law, Opalno and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Health issues, injuries, or adverse effects arising from any practice or routine performed in connection with the App
• Loss of data, streaks, scores, or progress
• Interruption of service or App unavailability
• Any errors or inaccuracies in App content
• Loss of profits or anticipated savings

Our total aggregate liability to you for any claim arising from or relating to your use of Forge shall not exceed the total amount you have paid to Opalno for the App in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Dutch or EU law, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence.

12. Termination

We reserve the right to restrict or terminate your access to the App at any time, without notice, for any reason, including but not limited to violation of these Terms.

You may stop using Forge at any time by cancelling your subscription through the Apple App Store and deleting the App. You may also delete your account and all associated data through Settings → Delete Account.

Sections 7 (Health Disclaimer), 8 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), and 14 (Governing Law) shall survive termination of these Terms.

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will provide at least 30 days' notice before the changes take effect, through one or more of the following methods:

• An in-app notification
• A notice on our website
• Update the “Effective” date at the top of this page

Continued use of Forge after changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree with the changes, you should cancel your subscription and stop using the App before the changes take effect.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the use of Forge shall be subject to the exclusive jurisdiction of the courts of The Hague, the Netherlands.

If you are a consumer in the EU, you also have the right to submit disputes to the EU Online Dispute Resolution platform.
