1. Who We Are

You must be at least 18 years old to use Malu.

By using Malu, you represent and warrant that you meet this eligibility requirement.

3. Account Registration

When you create an account, you agree to:

• Provide accurate and complete information
• Keep your account credentials secure
• Notify us promptly of any unauthorized access to your account

You are responsible for all activity that occurs under your account.

4. Subscriptions & Payments

Malu Premium is required for full access to the Services. Subscriptions are offered on weekly, monthly and quarterly plans. Malu offers three payment rails:

• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled.
• Free Trials: If offered, free trials convert to a paid subscription if not cancelled before the trial ends.
• Cancellation:
  • App Store: Cancel via Apple subscription settings at least 24 hours before renewal
  • Google Play: Cancel via your Google Play subscription settings at least 24 hours before renewal
  • Web: Cancel via opalno.com/account or email support@opalno.com
• After Cancellation: Access continues until the end of your current billing period. No partial refunds are issued except as required by applicable law.
• Price Changes: We will provide at least 30 days’ notice before any price changes take effect.
• Restore Purchases: Available in app settings to restore previously purchased subscriptions.

5. Your right to withdraw

If you are in the EEA, the UK or Switzerland, you have 14 days from the date you subscribe to withdraw and receive a full refund.

To withdraw, email support@opalno.com within 14 days of your purchase. You do not need to give a reason.

This applies to subscriptions bought on our website. Purchases made through the Apple App Store or Google Play are subject to their own refund policies and must be requested from them directly.

6. What you may not ask Malu to write

You may not use Malu to generate content that:

• sexualises children in any way, or depicts minors in sexual or romantic situations
• depicts real, identifiable people, whether public figures or private individuals
• promotes violence against any person or group, or incites hatred on the basis of race, religion, ethnicity, nationality, sex, sexual orientation, gender identity or disability
• provides instructions for weapons, explosives, drugs, or other criminal acts
• infringes anyone’s copyright or trade marks, including generating works derived from existing copyrighted characters or stories
• is intended to harass, threaten, defame or impersonate anyone

We screen what you write before generating a story. We may refuse any request without explanation, and we keep a record of refused requests. Repeated attempts to generate prohibited content may result in suspension or termination of your account without refund.

7. Stories are written by AI

Stories in Malu are written, narrated and illustrated by artificial intelligence based on what you describe. No person writes, reads or reviews a story before you hear it.

Stories are fiction. They may contain errors, inconsistencies, or content you did not expect, and nothing in a story is factual information, professional advice, medical advice, or advice about your own life, even where it appears to be.

Because stories are generated, we cannot guarantee that any story is unique. Another person describing something similar may receive a similar story.

You keep the rights to the description you write. We need a licence to store and process it in order to run the service. Stories generated for you are licensed to you for personal, non-commercial use only. You may not sell, publish or distribute them.

8. Use of the Services

We grant you a limited, non-exclusive, non-transferable, revocable license to use Malu for personal, non-commercial purposes, subject to an active subscription.

You agree not to:

• Copy, modify, or distribute any part of the Services
• Reverse engineer, decompile, or disassemble the software
• Circumvent any security or access controls
• Use automated systems to access or extract data from the Services
• Interfere with the proper functioning of the Services
• Resell, sublicense, or transfer your access

9. Intellectual Property

All content in the Services, including text, graphics, audio, software, and the Malu brand identity, is the property of Opalno or its licensors and is protected by Dutch and international intellectual property laws.

Audio Content

Audio content, including soundscapes, guided techniques and generated story narration, may not be recorded, redistributed, or used to create derivative works. Cached audio is licensed for personal offline playback only.

Rights in the descriptions you write and the stories generated from them are set out in Stories are written by AI.

All trademarks, service marks, and trade names are the property of Opalno and may not be used without written permission.

11. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

This disclaimer does not affect your statutory consumer rights under the laws of the EEA, UK, or Switzerland.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Opalno shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Our total aggregate liability shall not exceed the total amount you have paid to Opalno in the 12 months preceding the claim.

Nothing in these Terms limits liability for death, personal injury caused by negligence, or fraud.

13. Termination

You may terminate your account at any time:

• On the web: delete your account from opalno.com/account. You do not need to have installed the app.
• In the app: delete your account in app settings.
• By email: write to support@opalno.com and we will action it within 30 days.

Deleting your account cancels any active subscription bought on our website. Subscriptions bought through the Apple App Store or Google Play must also be cancelled with them.

We may suspend or terminate your access to the Services for breach of these Terms, legal requirements, or risk of harm. We will provide notice except where prevented by law or where immediate action is necessary.

14. Governing Law

• EEA, UK, and Swiss users: Your local consumer protection laws apply. Disputes may be brought before your local courts. You may also use the EU Online Dispute Resolution platform.
• All other users: These Terms are governed by the laws of the Netherlands. Disputes are subject to the jurisdiction of the courts of the Netherlands.

15. Apple App Store Terms

If you access Malu through the Apple App Store, you acknowledge that:

• These Terms are between you and Opalno, not Apple. Opalno is solely responsible for the Services.
• Apple has no obligation to provide maintenance or support for the Services.
• Apple is not responsible for any claims relating to the Services, including product liability, legal compliance, or intellectual property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Google Play Terms

If you access Malu through Google Play, you acknowledge that:

• These Terms are between you and Opalno, not Google. Opalno is solely responsible for the Services.
• Google has no obligation to provide maintenance or support for the Services.
• Google is not responsible for any claims relating to the Services, including product liability, legal compliance, or intellectual property claims.
• Your use of Google Play is also subject to the Google Play Terms of Service, and refunds for purchases made there are handled by Google.

17. Changes to Terms

We may update these Terms from time to time. We will provide at least 30 days’ notice for material changes through the app or our website.

Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
