1. Eligibility
You must be at least 16 years old to use Malu. If you are between 16 and 18 years of age, you must have the consent of a parent or legal guardian to use the Services.
By using Malu, you represent and warrant that you meet these eligibility requirements.
2. Account Registration
When you create an account, you agree to:
- Provide accurate and complete information
- Keep your account credentials secure
- Notify us promptly of any unauthorized access to your account
You are responsible for all activity that occurs under your account.
3. Subscriptions & Payments
Malu Premium is required for full access to the Services. Malu offers two payment rails:

- Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled.
- Free Trials: If offered, free trials convert to a paid subscription if not cancelled before the trial ends.
- Cancellation:
- App Store: Cancel via Apple subscription settings at least 24 hours before renewal
- Web: Cancel via opalno.com/apps/malu/manage or email support@opalno.com
- After Cancellation: Access continues until the end of your current billing period. No partial refunds are issued except as required by applicable law.
- Price Changes: We will provide at least 30 days' notice before any price changes take effect.
- Restore Purchases: Available in app settings to restore previously purchased subscriptions.
4. Withdrawal Rights (EEA, UK, Switzerland)
If you are in the EEA, UK, or Switzerland, you have a 14-day right to withdraw from your purchase and receive a full refund.
To exercise this right, contact support@opalno.com within 14 days of purchase.
Please note: your right of withdrawal may be lost if you have used the Services during the withdrawal period, in accordance with applicable law.
5. Use of the Services
We grant you a limited, non-exclusive, non-transferable, revocable license to use Malu for personal, non-commercial purposes, subject to an active subscription.
You agree not to:
- Copy, modify, or distribute any part of the Services
- Reverse engineer, decompile, or disassemble the software
- Circumvent any security or access controls
- Use automated systems to access or extract data from the Services
- Interfere with the proper functioning of the Services
- Resell, sublicense, or transfer your access
6. Intellectual Property
All content in the Services, including text, graphics, audio, software, and the Malu brand identity, is the property of Opalno or its licensors and is protected by Dutch and international intellectual property laws.
Audio Content
Audio content (soundscapes, guided techniques) may not be recorded, redistributed, or used to create derivative works. Cached audio is licensed for personal offline playback only.
All trademarks, service marks, and trade names are the property of Opalno and may not be used without written permission.
7. Health & Medical Disclaimer
Important
Malu is for informational and wellness purposes only. It is not medical advice and is not intended to diagnose, treat, cure, or prevent any condition.
- Consult a healthcare provider for medical questions about your sleep or health
- Discontinue use and seek medical advice if you experience any adverse effects
- Do not use Malu's sleep techniques while driving or operating machinery
8. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
This disclaimer does not affect your statutory consumer rights under the laws of the EEA, UK, or Switzerland.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Opalno shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
Our total aggregate liability shall not exceed the total amount you have paid to Opalno in the 12 months preceding the claim.
Nothing in these Terms limits liability for death, personal injury caused by negligence, or fraud.
10. Termination
You may terminate your account at any time by deleting your account in the app settings or by emailing support@opalno.com.
We may suspend or terminate your access to the Services for breach of these Terms, legal requirements, or risk of harm. We will provide notice except where prevented by law or where immediate action is necessary.
11. Governing Law
- EEA, UK, and Swiss users: Your local consumer protection laws apply. Disputes may be brought before your local courts. You may also use the EU Online Dispute Resolution platform.
- All other users: These Terms are governed by the laws of the Netherlands. Disputes are subject to the jurisdiction of the courts of the Netherlands.
12. Apple App Store Terms
If you access Malu through the Apple App Store, you acknowledge that:
- These Terms are between you and Opalno, not Apple. Opalno is solely responsible for the Services.
- Apple has no obligation to provide maintenance or support for the Services.
- Apple is not responsible for any claims relating to the Services, including product liability, legal compliance, or intellectual property claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. Changes to Terms
We may update these Terms from time to time. We will provide at least 30 days' notice for material changes through the app or our website.
Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
