Terms of Service

1. Agreement to Terms

By downloading, installing, or using WAWE (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

WAWE is provided by Opalno, a software company based in the Netherlands (“we”, “us”, “our”).

These Terms apply to all users of WAWE on any platform (iOS, Android). Please also review our Privacy Policy, which describes how we handle your data.

2. Description of Service

WAWE is a free meal planning app that provides the following features:

• Weekly meal plan creation and management
• Recipe suggestions and discovery
• Automatic shopping list generation
• Swipe-based meal selection
• Taste preference quiz for personalized suggestions

WAWE is free to use and supported by advertisements. The App does not require a user account. All meal plans, recipes, and shopping lists are stored locally on your device.

3. User Eligibility

You must be at least 13 years old to use WAWE. If you are between 13 and 16 years of age, you may only use the App with the consent of a parent or legal guardian, in accordance with GDPR requirements for minors in the EU.

By using the App, you represent that you meet these age requirements.

4. Recipe & Allergen Disclaimer

By using WAWE, you acknowledge and agree to the following:

• Allergen Responsibility: You are solely responsible for verifying all ingredients in any recipe before preparing or consuming food. Always check ingredient labels and packaging for the most up-to-date allergen information.
• No Guarantee of Accuracy: While we strive to provide accurate recipe information, we do not warrant or guarantee the accuracy, completeness, or reliability of any recipe data, ingredient lists, nutritional information, or allergen warnings displayed in the App.
• Cross-Contamination: Recipes do not account for the risk of cross-contamination during food preparation. If you have severe allergies, take appropriate precautions beyond what is listed in any recipe.
• Dietary and Medical Conditions: If you have food allergies, intolerances, dietary restrictions, or any medical condition that affects your diet, consult a qualified healthcare provider or registered dietitian before following any recipe or meal plan from the App.
• Nutritional Information: Any nutritional data shown in the App is an estimate only and may vary based on actual ingredients, portion sizes, and preparation methods.
• No Liability: Opalno is not liable for any adverse reactions, health issues, allergic reactions, illness, or injury resulting from the preparation or consumption of any recipe or meal suggestion provided through WAWE.

5. Intellectual Property

All content in the App, including but not limited to recipes, text, graphics, icons, images, user interface design, and software, is the property of Opalno or its content suppliers and is protected by Dutch and international copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. This license does not include the right to:

• Copy, reproduce, or redistribute App content
• Modify, adapt, or create derivative works from the App
• Use App content for any commercial purpose
• Remove any copyright or proprietary notices

6. Acceptable Use

You agree not to:

• Use automated systems (bots, scrapers, crawlers) to extract data or content from the App
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to interfere with the App's functionality, servers, or networks
• Republish or commercially exploit App content without written permission from Opalno
• Circumvent, disable, or interfere with advertising or consent mechanisms in the App

7. Disclaimer of Warranties

8. Limitation of Liability

To the maximum extent permitted by applicable law, Opalno and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data stored locally on your device
• Health issues, allergic reactions, or injuries arising from the use of recipes or meal suggestions
• Interruption of service or App unavailability
• Any errors or inaccuracies in App content

Since WAWE is a free app, our total liability to you for any claim arising from the use of the App is limited to zero euros (€0). This limitation applies regardless of the legal theory under which the claim is brought.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Dutch or EU law, including liability for fraud or intentional misconduct.

9. Advertising

WAWE is a free app supported by advertising. By using the App, you acknowledge that:

• The App displays advertisements provided by Google AdMob
• You will be asked for consent regarding personalized advertising in compliance with GDPR
• Ad content is provided by third parties and does not represent endorsement by Opalno
• Advertising is governed by Google's advertising policies

10. Termination

We reserve the right to restrict or terminate your access to the App at any time, without notice, for any reason, including but not limited to violation of these Terms.

You may stop using the App at any time by uninstalling it from your device. Upon uninstallation, all locally stored data (meal plans, shopping lists, preferences) will be permanently deleted.

Sections 4 (Recipe & Allergen Disclaimer), 5 (Intellectual Property), 7 (Disclaimer of Warranties), 8 (Limitation of Liability), and 12 (Governing Law) shall survive termination of these Terms.

11. Changes to Terms

We may update these Terms from time to time. When we make changes, we will:

• Update the “Effective” date at the top of this page
• Post a notice in the App or on our website for significant changes

Continued use of WAWE after changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree with the changes, you should stop using the App and uninstall it.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the use of WAWE shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If you are a consumer in the EU, you also have the right to submit disputes to the EU Online Dispute Resolution platform.
